Jamii Save Terms and Conditions

1. Introduction

Welcome to Jamii Save ("Platform", "Service", "we", "us", or "our"). By accessing or using our community savings platform, you agree to be bound by these Terms and Conditions. Please read them carefully before joining any community or making contributions.

2. Definitions

  • "Community" - A group of members who pool their savings together for mutual benefit.
  • "Member" - An individual who has accepted an invitation and joined a Community.
  • "Admin" - A member with administrative privileges to manage a Community.
  • "Contribution" - A monetary payment made by a member to their Community's savings pool.
  • "Fund Request" - A formal request by a member to borrow or withdraw funds from the Community.

3. User Responsibilities

3.1 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.3 Prohibited Activities

You agree not to:

  • Use the Platform for any illegal or unauthorized purpose
  • Misrepresent your identity or affiliation with any person or entity
  • Submit false or fraudulent contribution proofs
  • Interfere with or disrupt the Platform's functionality
  • Attempt to gain unauthorized access to other members' accounts

4. Financial Transactions

4.1 Contributions

All contributions are voluntary and subject to Community rules. Members must provide proof of payment for offline contributions. Contributions are subject to admin approval before being credited to the Community balance.

4.2 Fund Requests

Fund requests (loans or grants) are subject to Community approval processes. Approved loan amounts, interest rates, and repayment schedules are determined by Community admins and are binding once accepted by the requestor.

4.3 Refunds

Jamii Save is a facilitator platform. All financial disputes must be resolved within the Community. We do not process refunds directly but provide tools for Communities to manage their finances.

4.4 Currency and Exchange

Each Community operates in a single currency. Members are responsible for any currency conversion costs when making contributions in different currencies.

5. Privacy and Data Protection

We collect and process personal data in accordance with applicable privacy laws. By using Jamii Save, you consent to:

  • Collection of your name, email, phone number, and financial transaction records
  • Sharing of your contribution history and financial data with Community admins
  • Storage of uploaded documents (proof of payments, receipts) on secure cloud servers
  • Use of your data for platform analytics and service improvement

6. Liability and Disclaimers

6.1 Platform Role

Jamii Save is a technology platform that facilitates community savings management. We are not a financial institution and do not hold, manage, or control member funds directly.

6.2 No Financial Advice

We do not provide financial, investment, or legal advice. All financial decisions made through the Platform are the sole responsibility of Community members and admins.

6.3 Limitation of Liability

To the fullest extent permitted by law, Jamii Save shall not be liable for:

  • Loss of funds due to Community mismanagement or member disputes
  • Unauthorized access to accounts due to user negligence
  • Service interruptions or technical failures
  • Indirect, incidental, or consequential damages

6.4 Service Availability

We strive to maintain continuous service but do not guarantee uninterrupted access. The Platform may be unavailable during maintenance or due to technical issues beyond our control.

7. Subscription and Payments

Jamii Save offers different subscription tiers (Freemium, Standard, Premium). By subscribing to a paid plan, you agree to:

  • Pay the subscription fees as advertised on our Pricing page
  • Automatic renewal of your subscription unless cancelled
  • No refunds for partial subscription periods
  • Our right to change pricing with 30 days advance notice

8. Termination

8.1 By User

You may terminate your account at any time by contacting us at izyo.group@gmail.com. Termination does not absolve you of financial obligations to your Community.

8.2 By Jamii Save

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activities, or for any other reason at our sole discretion.

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of Canada and Rwanda, depending on where the Community operates. Any disputes arising from these Terms shall be resolved through:

  1. Good faith negotiations between the parties
  2. Mediation, if negotiations fail
  3. Binding arbitration or court proceedings in the applicable jurisdiction

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of Jamii Save after changes constitutes acceptance of the modified Terms. We will notify users of material changes via email or in-app notification.
